About Us
According to Article 105(1) of the Somali Provisional Constitution, the judicial authority is vested in the courts. The Supreme Court is the highest court in the country in accordance with Article 108(c). Article 5 of the Organisation of the Judiciary of 1962 expressly outlines the mandate of the Supreme Court. It provides:
- The Supreme Court shall ensure respect for, and the uniform application of the law and, shall exercise any other function as may be attributed to it by the constitution or by law;
- Cases before the Supreme Court shall be heard by a Division Bench of three judges. Such Bench shall have jurisdiction over:
- Appeals against judgements given by any court in its appellate jurisdiction or against judgements given by any court from which appeals lie directly to the Supreme Court;
- Petitions against final decisions of the Public Administration;
- Petitions relating to the rendering of accounts by officers handling public funds;
3. A full bench of the Supreme Court shall consist of five judges and shall have jurisdiction over:
- Petitions disputing the validity of the election of deputies to the National Assembly;
- Controversies relating to conflict of jurisdiction or competence among judicial organs;
- Any other matter considered by the President to be particular importance, even though such matter is within the scope of the previous paragraph.
Seat of the Court and Composition
According to Article 5(1) of the Organization of the Judiciary, the Supreme Court shall have its seat in Mogadishu and shall have jurisdiction over the whole territory of the Republic. It shall consist of the President, a Vice President, and four judges, who collectively ensure the uniform application of the law and uphold the principles of justice nationwide.
